  • Here in after, wherever the word 'AapniCar' appears in this document, it represents 'AapniCar Services Private Limited' and wherever the word ‘Customer’ or 'User' appears in this document, it represents the person who has booked the vehicle from AapniCar after agreeing to all the below mentioned terms and conditions.
  • The terms and conditions are subject to change and AapniCar reserves the right to make the changes from time to time without any prior notice. Customers are requested to go through the policies every time before making the booking.
  • AapniCar is an online aggregator of vendors who rent out vehicles. It does not operate vehicle services of its own. In order to provide a comprehensive choice of vehicles to users, it has tied up with multiple vehicle rental vendors at different locations.

The renter should be at least 22 years old or above for renting a Self-Drive car. She/he should also possess a valid driving license. Documents needed to rent a Self Drive car: A valid Driving License (LMV) / Passport / Aadhar Card/ Occupation Job & Business/ student id card need visiting card, id card, etc.

Aapni has all the right to refuse renting a car to any person whomsoever considered unfit to drive or does not fulfill all or any of the requisite requirements, our T&C. Aapni has all the right to Bookings canceled with a retion our T&C any douts.

In case of vehicle breakdown, it is the user`s duty to inform Aapni immediately. Customers are advised not to drive the car if it gets damaged in an accident or develop any faults. If the vehicle cannot be repaired at the location of breakdown, a replacement vehicle will be provided by Aapni, subject to availability. The renter should make sure that the vehicle is properly locked when unattended and must not be parked in no-parking zone or any public area for long periods. The renter is completely responsible for the security of vehicle and in the event of theft is liable to pay the calculative amount.

Member is violating the law or Aapnicar rules, for example by overspeeding or driving drunk, the member will be responsible for all damage, liability, and fines and could face legal action The renters cannot use Aapni's vehicle as a taxi or for transporting people in exchange of money; it is solely for the purpose of personal use. The user cannot be under the influence of Alcohol and/or any other narcotic substance which can impair the user’s ability to drive. The user must ensure that the number of passengers in the vehicle does not exceed the number of seat belts provided in the vehicle. The vehicle cannot be used for any activity which is deemed illegal by the Indian penal code. Customers are not allowed to carry arms, ammunitions and banned drugs.

The rental starts and finishes according to the pickup and drop-off dates and times documented. Aapni is not liable to provide any refunds for an unused time if a car is picked up late or dropped off early.

The renter is solely liable to pay for any traffic violation tickets received during their journey. The renter will pay the charge if the traffic department will sent the violation tickets directly to the company.

Rs 500 will be deducted from the security or advance payment, if the cancellation information is given to the company after the reporting time of the cab. The cancellation can be done over the phone before a day of scheduled reporting time.

The renter has to pay a total amount of Rs 5000 for taking any economy budget car as a security deposit and Rs 5,000 for luxury car. At the time of delivery of the Vehicle to the User, Aapni shall have the right to block an advance deposit in case of any unpaid dues as per these Terms and Conditions and/or damage to the Vehicle.

Renter whole shoal are responsible for maintaining the Safety & Traffic rules. Fill the checklist point and Check vehicle in the AapniCar.

Member must co-operate with the representative of Aapnicar in taking a photo of Vehicle along with Member, which is meant for safety of Member and record purposes of AapniCar Cleaning required (interiors) Washing of removable s (for foot mats etc) would be charged @500/. Interior Washing / Dry cleaning (for seat covers, door panels) would be charged @1000/

The Vehicle may be enabled with speed governor in compliance with the applicable Government regulations that limits speed of the Vehicle up to 80 km/h. You will also be notified by SMS on your registered number. Over Speed Fine @ 500 will be deducted.

Return the car to the same location and fill the end checklist to end your trip. Late return would be charged @ 250/hour in addition to the hourly fee for use of the vehicle.

Rules & Liability OF RENTER. Payments owed by members will be deducted from the security deposit. If the security deposit does not cover such payments, the balance must be paid by the member electronically. AapniCar members must be at least 22 years of age. AapniCar members should hold a valid Indian driving licence. If not an Indian citizen, member must have a valid International driving licence. AapniCar members must be free from alcohol or drug related driving violations in the past five years. AapniCar members must not have any driving accident history in their record.

A user can cancel a booking either by calling our customer care number : 1800-889-3787 or by mailing us at care@aapnicar.com. Applicable refund will be credited back to the same mode and Name of payment used at the time of booking within 5 to 7 working days. Following cancellation charges will apply based on cancellation time with respect to expected departure time of booking: More than 48 hours before trip start time 20% of the booking amount Between 24-48 hours of trip start time 50% of the booking amount Less than 24 hours before trip start time 100% of the booking amount NO REFUND

Securty Deposit Refund amount applicable based no any disput /return policy will get credited to the payment mode selected by customer in 2-3 working days. Deposit amount may take 2-3 workings days to reflect in your account. Every user must register on our website or through our mobile application. It is user’s responsibility to provide and maintain correct email address, contact number, postal address, and other account information at the time of registration. A user can book a vehicle only after he/she has registered with Rideinsta. The user must be 22 years of age or older and should hold a valid Indian driving license. If the user is not an Indian citizen, he/she must have a valid International driving license. Rideinsta reserves the sole right of granting membership to any applicant. Rideinsta can refuse membership to any applicant, even if he/she satisfies all the above criteria. An applicant, on application for membership, authorizes Rideinsta to verify the submitted documents through the concerned authorities. A user is not allowed to create multiple accounts.

The user has to present a valid driving license at the vendor location before pickup. In case the user is unable to present the same, the booking shall stand canceled. If the user is not an Indian citizen, he/she must present a valid International driving license at the vendor location before pickup. In addition to the above, user has to produce any one of the following ORIGINAL Identity Proofs at the time of picking up the vehicle- Aadhar Card, Passport, Job ID Card or Visiting Card, etc.

AapniCar vehicles can only be driven by registered members. Persons not registered on AapniCar, but accompanying AapniCar members are not allowed to drive the vehicle. AapniCar members whose driver’s license has expired will not be allowed to make bookings. AapniCar vehicles are meant solely for personal use. Members can’t use Rideinsta vehicles for commercial use, such as using it as a taxi for transporting people. AapniCar vehicles must not be used for any contests like races or for exhibitions. AapniCar vehicles must not be used for towing, pushing and/or propelling another vehicle or object. AapniCar vehicles must not be used by a user under the influence of any substance that impairs his/her ability to drive, like alcohol, drugs, narcotic substances. A zero-tolerance policy is adopted in such cases. AapniCar vehicles must not be used for carrying out any crime or illegal activity. AapniCar users must not drive a vehicle while using a mobile phone or any other mobile communication device in any manner whatsoever, with or without a hands-free device that may distract them from driving or otherwise engaging in similar activities that may be prohibited by the law. AapniCar users are not allowed to carry the following items while driving the vehicle: Any object whose possession has been deemed illegal by the Indian penal code. Weapons or any sharp or inflammable object which may cause damage to the vehicle or endanger human life. Any other object which compromises the stability, safety or performance of the vehicle and/or the passengers. AapniCar holds the right to refuse a booking if the user is found to possess any of the above items. AapniCar vehicles must not be used for transporting objects that could – due to their size, shape, or weight – adversely impact the vehicle. AapniCar vehicles can be used only in the Republic of India. Use of the vehicles is subject to the laws of India. The vehicle cannot be driven in areas where entry is prohibited by the central or state government. The terms of vehicle use listed above are non-exhaustive. Any negligent or use in an abusive manner, as determined by AapniCar in its sole discretion, may be deemed a violation of these terms and conditions. Illegal use of the vehicle will be reported to the concerned authorities by Rideinsta followed by the suspension or termination of service immediately. In the case of non-compliance, appropriate actions may be taken against the user by the concerned local, state, and/or national authorities. In such scenario, the entire sum of security deposit will be retained by Rideinsta.

AapniCar users are required to make reservations in advance and prior to pick-up. Bookings are done on a first come first serve basis. Availability of a particular vehicle at all times is not guaranteed by Rideinsta. Booking requests should be made at least 2 hours prior to pick-up time. Requests with a lesser time gap will not be entertained. If a user wishes to extend the duration of his/her booking, he/she can do so on the AapniCar website or mobile application. User can also get in touch with the AapniCar customer care. Extension depends on the availability of the vehicle for the requested period of time. Extra charges for the extended period of time will be calculated as per regular rates. Please refer AapniCar fee policy for more information. If your extension request is not approved or denied by AapniCar and you do not return the vehicle to the designated AapniCar drop-off location by the end of your original reservation time, AapniCar reserves the right to take possession of the vehicle from you immediately or any time thereafter, and at any location. In such an event, You will be charged late fee, inconvenience fee and any other charges applicable as per AapniCar’s fee policy from the scheduled end time of your original booking till the time the vehicle is recovered from you. You will also be liable to pay any additional costs incurred by AapniCar in taking possession of the vehicle from you, and You will not be provided any compensation or alternate means of transportation in such case and will not have the right to ride in the AapniCar vehicle any more. All expenses incurred during the rental period on the vehicle such as parking fee, fine, tickets/challans, etc. will be borne by the user. Settling Claims Arising out of Accidents/Theft of Vehicles/Loss of Vehicles during Booking Period In case of any accident related damage to the vehicle or theft of vehicle or in a case when the vehicle is lost or misplaced, the incident would be resolved mutually between the vehicle vendor and the user.

The customer is expected to check, inspect and test ride the vehicle before taking delivery and convince himself/herself with regards to the quality of the vehicle. Once the customer picks up the vehicle from the vendor, it is deemed that the customer is satisfied with the quality of the vehicle and absolves AapniCar of any liability that might arise due to any damage caused to life, health or property that should occur due to any mechanical malfunction of the vehicle or any of its parts or accessories. The vehicle has to be picked up from and dropped within the office timings of the vendors. While returning the vehicle, the user must hand over the keys at the designated drop-off location. Trip will not be terminated until the keys are returned, and the user will be billed accordingly. The vehicle must be returned at the authorized AapniCar drop-off location only. If the user fails to return the vehicle to the designated drop-off location on time for any reason whatsoever, penalty will be levied on the user.

AapniCar users will be responsible for any traffic rule violations (if any). This includes but is not limited to: incorrect parking, over-speeding, breaking red light at a signal and toll violations. The user will be liable for all the fines/penalty arising out of such violations. In case of such violations, the user must inform AapniCar immediately. AapniCar will inform the user about such an event, if it learns of such an event from a third party. The user will be required to pay the relevant fines/penalty to the concerned authorities and submit a proof of such payment to AapniCar. AapniCar is not obligated to inform the user, if the user has prior knowledge of such violations. Any unreported traffic rule violation will be solely the user’s responsibility and AapniCar will not bear any responsibility whatsoever. AapniCar users must not park a vehicle in no parking areas. User will be solely responsible for all the violation notices and towing charges (if any), if he/she leaves the vehicle in such a restricted zone. This may also lead to additional penalties being levied on the user, if the violation leads to unavailability of the AapniCar vehicle for other reservations.

In case of any damage caused to the vehicle during the period in which the vehicle is in possession of the customer, due to any accident or otherwise, whether or not due to the negligence of the customer, customer has to pay the amount for vehicle repairing. The fare does not include fuel costs and the toll taxes to be paid. Change of Vehicle: In case the vendor changes the type of vehicle due to some reason, AapniCar will refund the differential amount to the customer upon being intimated by the customers within 24 hours of the journey. AapniCar is an aggregator that connects the vendor and the user. In case of any dispute, it should be resolved between the vendor and the user. The vehicles and other suppliers providing travel or other services for AapniCar are independent contractors and not agents or employees of AapniCar are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Rideinsta has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority. The security deposit will be refunded only after checking the damages and if any damage is found, it will be deducted from the deposit. Prior to taking any vehicle, the user must document any pre-existing damage, and have the vendor acknowledge it as well. In case of any concerns, the user may take photos at the start of the reservation and mail it to care@aapnicar.com. Otherwise, the user may be held liable for any damage reported after the reservation.

In case of any legal dispute or conflict between AapniCar and its users arising from the services of AapniCar, the sole and exclusive jurisdiction lies with the courts of Chhattisgarh, India. The user is liable to pay AapniCar’s reasonable attorney fees and bear the cost of legal proceedings relating to this agreement, including appeals. 28. Vehicle rental charges are applicable on an hourly as well as daily basis. The minimum booking period is 24 hours. AapniCar rental charges are divided into following categories: Peak Season Rates: Applicable on festivals, extended weekends etc. For details, refer our calendar. b. Normal Rates: Applicable on all other dates apart from peak season defined dates. All charges are inclusive of Service Tax. AapniCar retains the rights to change rental rates and peak season dates at any point of time. Penalties: List of penalties that can be levied on the user, if AapniCar rules are violated: Late Return - Check individual Terms and Conditions of the vendor displayed below the vehicles Key lost / not returned at end of ride - Full cost to be borne by the user Vehicle Towing - No cost if caused by vehicle failure. / Full cost if caused by user negligence. Damage to vehicle caused by accident - Full cost to be borne by the user Loss of any other accessories - Full cost to be borne by the user AapniCar collects following information from its users when they sign up on its website or smartphone-based applications: AapniCar collects following information from its users during the rental period:

All vehicles of AapniCar have GPS tracking devices installed in order to ensure the safety of the passengers and the vehicle. AapniCar tracks the real time location of all its vehicles. AapniCar will not public ally divulge any of this information. However, AapniCar may share this information with the police or similar concerned authorities in the event of an accident or mishap. AapniCar also reserves the right to share any information pertaining to the location of the vehicle with insurance companies in the event of any damage/accident claim or theft.

AapniCar collects and monitors data related to vehicle use in order to prevent misuse, like over speeding etc., and theft of the vehicle. AapniCar reserves the right to access user’s driver record and vehicle history from all the Departments of Vehicles, Registry of Vehicles, automobile mechanics and other relevant authorities.

Members are responsibility check all points of Handover checklist and agreement like Battery, Light, Horn, Wiper, Brecks, Tolls, Air Tyres, Music, key lock system, AC, Oil, Coolant, etc. Check fuel RNG or Leval Point maintain same on condition if fuel low so that charges apply as per fuel cost.

the online payment for the extension has been made and successfully receipt by AapniCar; and the Vehicle is available for use for the extension period (for example, it is not reserved by another Member) the request to extend is completed prior to the scheduled expiration time of Your existing reservation. In case, any of the above conditions are missing after the expiry of the booking (initial or immediate prior) then You will be deemed to possess the vehicle without authorization and must hand over the Vehicle to AapniCar’s parking or its representative without fail/ delay. A delay beyond one hour from the expected handover time of vehicle or after the expiry of booking as the case may be, will be making You the guilty of breach of trust and Your involvement in theft of Vehicle would be presumed without any doubt.
